Terms and conditions

 

§ 1 Preliminary provisions

 

1. These terms and conditions define the rules for the provision of services by the BITULROPES online store, available at https://bitulropes.com, run by the company Bitul Zbigniew Sołomieniuk, entered into the Central Registration and Information on Economic Activity (CEIDG), VAT number PL7841983016, REGON 634619289.

2. These regulations are addressed to both Entrepreneurs and Consumers and specify the rules and procedure for concluding a Sales Agreement with the Entrepreneur via the Store.

§ 2 Definitions

 

1. Consumer - a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to his business or professional activity.

2. Seller - a natural person running a business under the name Bitul Zbigniew Sołomieniuk entered into the Central Register and Information on Economic Activity (CEIDG) VAT number PL7841983016, REGON 634619289.

3. Customer - any entity making purchases via the Store.

4. Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, which is granted legal capacity by a separate act, conducting business activities on its own behalf, and using the Store.

5. Store - online store run by the Seller at the Internet address https://bitulropes.com.

6. Sales Agreement - a Product sales agreement concluded between the Customer and the Seller via the Online Store.

7. Distance contract - a contract concluded with the Customer as part of an organized system for concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.

8. Term and Cohditions - these regulations of the Store.

9. Order - the Customer's declaration of will submitted using the Order Form and aimed directly at concluding a Sales Agreement for the Product or Products with the Seller.

10. Account - the customer's account in the Store, which collects data provided by the Customer and information about Orders placed by him in the Store.

11. Registration form - a form available in the Store, enabling the creation of an Account.

12. Order form - an interactive form available in the Store enabling placing an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

13. Cart - an element of the Store's software in which the Products selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.

14. Product - a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.

 

§ 3 Contact with the Store

8. The Customer can communicate with the Seller by phone on business days from Monday to Friday from 8 a.m. to 4 p.m. CET.

 

§ 4 Technical requirements

 

To use the Store, including viewing the Store's assortment and placing orders for Products, you need:

a) end device with access to the Internet and a web browser such as Mozilla Firefox, Google Chrome, Microsoft Edge,

b) active e-mail account,

c) cookie support enabled.

 

§ 5 General information

 

1. To the fullest extent permitted by law, the Seller is not liable for any disruptions, including interruptions in the operation of the Store caused by force majeure, unauthorized action of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.

2. Browsing the Store's assortment does not require creating an Account. The Customer may place orders for Products included in the Store's assortment by providing the necessary personal and address data enabling the execution of the Order without creating an Account.

3. The prices given in the Store are given in EURO (they are gross prices - they include VAT). The price binding for the execution of the order is the price valid on the day of placing the order.

4. The final amount to be paid by the Customer consists of the price for the Product and the delivery cost (including transport and delivery fees) and VAT (dipends from the Customer's Country)

5. If the nature of the subject of the Agreement does not allow, reasonably to be assessed, the amount of the final price to be calculated in advance, information on the manner in which the price will be calculated, as well as on fees for transport, delivery, postal services and other costs, will be determined with the client individually.

 

§ 6 Rules for placing an Order

 

1. Orders can be placed 24 hours a day, 7 days a week, all year round. Orders placed on business days, Saturdays, Sundays and holidays will be accepted for processing on the next business day. Working days are all days of the week, except Saturdays, Sundays and days considered public holidays under separate regulations. In order for the Customer to place an order in the Store, it is necessary to accept these Terms and Conditions.

2. The customer places an order via the Store's website. Ordering a specific product by the Customer constitutes the Customer's submission to the Seller of an offer to conclude a distance sales contract on the terms arising from the content of the Store and these Terms and Conditions.

3. The customer can place an order as a registered or as a guest.

4. A registered customer is a customer who has an account on the Store's website.

5. To place an order via the Bitulropes.com/eu website, follow these steps:

a) select the product or products that are the subject of the order by clicking the "Add to cart" button,

b) log in to your account in the Store, create an account or continue placing an order as a guest - does not apply to the Customer who logged in to his account before placing an order,

c) provide invoice data and shipping address, if different from the address indicated for the invoice - if the Customer has already added specific data to the account, he or she may select them without having to complete them again or provide other data,

d) choose a payment method,

e) read the Regulations and accept them - the Customer accepts the Regulations only if he has read its content and actually accepts its provisions; acceptance of the Regulations is voluntary, but necessary to place an order,

f) click the "Place an order" button.

 

6. If the Customer has chosen to pay for the order via Mollie or PayPal, after clicking the "Buy and pay" button, he or she will be redirected to the website's transaction page to make payment for the order. After making the payment, the Customer will be redirected to the Store's website with confirmation of the order.

7. If the Customer has chosen to pay for the order by transfer, he will receive information about the account details for the transfer.

8. After successfully placing the order, the Customer receives an e-mail with information about registering the order, which confirms that the Seller has received the offer from the Customer. Receiving the above e-mail message means that the Seller accepts the Customer's offer and concludes a distance sales contract for specific goods.

9. The Seller is entitled to cancel the order if the Customer provides incomplete or false data, which may prevent the execution of the order.

10. Standard order processing time is up to 10 business days (usually 5 business day), provided the goods are available in stock. In the event of unavailability of the goods covered by the order, the Customer is informed about the status of the order and decides on the method of its implementation (partial implementation or cancellation of the entire order).

11. If the order is not paid by the Customer within 14 days from the date of its submission, it is canceled.

 

§ 7 Delivery and payment methods offered

 

1. The customer can use the following payment methods:

a) Payment by traditional transfer to the Seller's account,

c) Electronic payments (card or transfer) – via Mollie

c) Payment via PayPal

d) Individual arrangements.

2. The Customer may use the following methods of delivery or collection of the ordered Product:

a) Courier delivery after payment through the bitulropes.com/eu store;

b) Parcel locker shipment after payment through the bitulropes.com/eu store (depending on the shipping country)

 

§ 8 Performance of the sales contract

 

1. The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer places an Order using the Order Form in the Store in accordance with § 6 of the Terms and Conditions.

2. After placing the Order, the Seller immediately confirms its receipt and acceptance of the Order for execution. Confirmation of receipt of the Order and its acceptance for execution takes place by sending the Customer an appropriate e-mail to the Customer's e-mail address provided when placing the Order,

3. The customer is responsible for providing false personal data. The Seller reserves the right to refuse to process and cancel an order for the Product if the Customer has provided false data in the registration form or if the data raises justified objections to the Seller as to their correctness. In such a case, the Customer will be informed by phone or e-mail about the reasons for canceling the order. In such a situation, the Customer has the right to explain all circumstances related to verifying the accuracy of the provided data and canceling the order. If there is no data allowing the Seller to contact the Customer, the Seller will provide any explanations after the Customer contacts him.

4. The Customer declares that all data provided by him in the order form is true, but the Seller is not obliged to verify their truthfulness and correctness.

5. If the Customer chooses:

a) payment by bank transfer, the Customer is obliged to make the payment within 14 calendar days from the date of conclusion of the Sales Agreement - otherwise the order will be canceled.

b) cash on delivery upon receipt of the shipment, the Customer is obliged to make the payment upon receipt of the shipment.

c) payment via the Mollie website, the Customer is obliged to make the payment immediately.

d) Individual arrangements - the payment date is agreed directly with the Seller.

6. The Product will be sent by the Seller within the time specified in section 7 of this paragraph, in the manner chosen by the Customer after placing the Order. If you order Products with different delivery dates, the delivery date is the longest given date.

7. The beginning of the delivery period of the Product to the Customer is counted as follows:

a) If the Customer chooses the payment method by transfer - from the date of crediting the Seller's bank account.

b) If the Customer chooses the cash on delivery method of payment - from the date of conclusion of the Sales Agreement.

c) In the case of ordering Products with different dates of readiness for collection, the Customer has the option of collecting the Products in parts (according to their readiness for collection) or collecting all the Products after completing the entire order.

8. Delivery of the Product to the Customer is subject to payment, unless the Sales Agreement provides otherwise. Product delivery costs are indicated to the Customer at the order summary stage. Transport fees and other delivery costs may be charged individually in certain cases.

 

§ 9 Right to withdraw from the contract

 

1. The Customer who is a Consumer may withdraw from the Sales Agreement without giving any reason within 14 days.

2. Withdrawal from the contract does not apply to orders for non-standard products made at the individual request of the customer, such as: ropes cut to size, hotel ropes made to size, etc.

3. The period specified in section 1 begins with the delivery of the Product to the Consumer or a person other than the carrier indicated by him.

4. In the case of an Agreement that covers many Products that are delivered separately, in batches or in parts, the deadline specified in section 1 runs from the delivery of the last item, batch or part.

5. The Consumer may withdraw from the Agreement by submitting a declaration of withdrawal to the Seller. To meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send a statement before the deadline.

6. The declaration may be sent by traditional mail or electronically by sending the declaration to the Seller's e-mail address. The Seller's contact details are specified in § 3. The declaration can also be submitted on the form, the template of which is Annex 1 to these Terms and Conditions and the Annex to the Act of May 30, 2014 on Consumer Rights, but this is not obligatory.

7. If the Consumer sends the declaration electronically, the Seller will immediately send the Consumer confirmation of receipt of the declaration of withdrawal from the Agreement to the e-mail address provided by the Consumer.

8. Effects of withdrawal from the Agreement:

a) In the event of withdrawal from a distance contract, the contract is deemed not to have been concluded.

b) The Customer who is a Consumer is obliged to immediately return the originally packaged Goods to the Seller along with the proof of purchase/VAT invoice, but no later than within 14 days from sending the declaration. Returned Goods must be complete. It is permissible to use substitute packaging, but it should provide adequate protection during transport. Returned ropes should be tied and intact as at the time of delivery. It is unacceptable to cut the rope or remove the tape securing the ends.

c) The refund will be made within 7 business days from the date of receipt of the returned Goods by the Seller.

d) In the event of withdrawal from the Agreement, the Seller returns the value of the returned Product or products to the Consumer immediately, no later than within 7 days from the date of receipt of the returned Goods by the Seller.

e) Transport costs are non-refundable. The exception is the situation when the return is due to the Seller's fault.

f) The payment will be refunded by the Seller using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution that will not involve any costs for him.

g) The Consumer bears the direct costs of returning the Product, unless the return is due to the Seller's fault. The consumer bears the costs of returning the goods if the seller provides a return address in the buyer's country.

If the product is returned to Poland, the customer covers the return costs, which, after agreement with the Seller, will be refunded together with the repayment for the returned goods.

h) The Consumer is only responsible for the reduction in the value of the Product resulting from using it in a manner other than what was necessary to establish the nature, characteristics and functioning of the Product.

9. If, due to the nature of the Product, it cannot be returned by regular mail, information about this, as well as the costs of returning the Product, will be provided to the Customer individually.

10. In the case of Customers who are not Consumers, the provisions contained in this paragraph do not apply.

§ 10 Complaint and warranty

 

1. The Sales Agreement covers new Products.

2. The Seller is obliged to provide the Customer with an item free from defects.

3. The goods offered by the Seller in the Store are properly secured and packed so that they reach the Customer intact.

4. In the event of a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the provisions on warranty in the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability under the warranty.

5. The Goods covered by the complaint must be accompanied by proof of purchase or a VAT invoice.

6. Damage resulting from inadequate protection for the transport of goods sent to the Seller is not subject to complaint.

7. Complaints should be submitted in writing or electronically to the Seller's addresses provided in these Terms and Conditions.

8. Each complaint will be carefully considered and the Customer will be notified of its results in the form in which the complaint was submitted within 28 days.

9. In the complaint, the Customer should provide the reason and the related request. The customer has the right to demand replacement of the product with a new one (or repair, if the nature of the product allows such repair), exchange of the Goods for another Good at the same price, reduction of the price of the Goods or refund of the money.

10. If the complaint is deemed justified, the damaged Goods will be repaired or replaced with full-value ones. If the complained Good is missing, the Seller will refund the Customer the equivalent of the price of the Good within 14 days or offer another one.

11. If the complaint is deemed justified, the goods will be returned to the Customer at the Seller's expense.

12. If the complaint is rejected, the cost of returning the complained Goods is borne by the Customer.

13. The Seller does not accept complaint shipments whose shipment has not been previously agreed.

14. Complaints about wear and tear of hotel ropes and lines resulting from their use are not accepted.

 

§ 11 Personal data in the Online Store

 

1. The administrator of Customers' personal data collected via the Online Store is the Seller.

2. By placing an order, the Customer consents to placing his personal data in the Seller's database and to their processing for the purposes of order fulfillment. Providing personal data by the Customer and consent to their processing are necessary to complete the order.

3. The customer is responsible for providing false personal data.

4. Personal data is protected in accordance with the Regulation of the European Parliament and of the EU Council 2016/679 of 27/04/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) .

5. The Customer may consent to receiving free marketing information about new products and interesting products offered by the Seller.

6. Providing personal data is voluntary, although failure to provide the personal data indicated in the Terms and Conditions necessary to conclude the Sales Agreement results in the inability to conclude this agreement.

7. Each customer has the right to access their data, rectify it, delete it, limit its processing, and object to the processing of personal data in the order fulfillment process. Any comments or requests should be sent to the Seller's e-mail address.

8. The data is used only for the proper functioning of the sales procedure within the store and to complete the order within the company. (sales and trade IT system, courier company to deliver the parcel to the indicated address).

9. The recipients of personal data of Online Store Customers may be a selected carrier or intermediary carrying out shipments on behalf of the Administrator.

 

§ 12 Final provisions

 

1. Agreements concluded via the Online Store are concluded in Polish.

2. Agreements between the Parties, including issues regarding their conclusion, performance and termination, as well as legal relations related to the use of the Store, are subject to Polish law.

3. In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Consumer Rights Act and other relevant acts shall apply.

4. The Seller complies with the code of practice referred to in Art. 2 section 5 of the Act of 23 August 2007 on counteracting unfair market practices.

5. Copying for commercial or non-private purposes, reproducing, disseminating by any printing or electronic method, any other use in whole or in part of information, data and other content from the website located at https://bitulropes.com/eu without consent Seller, is prohibited.

6. By using the website https://bitulropes.com/eu, the Customer consents to the use of cookies in accordance with the current browser settings.

7. These Terms and Conditions are valid from December 1, 2023

8. The Seller reserves the right to change these Terms and Conditions.
